SERVICE PROVISION AGREEMENT

Visitors and members of the ULTRAFLEX Gym are kindly requested to carefully read the following terms of use, which constitute the terms of the service provision contract between the parties. These terms regulate the rights and obligations related to the use of the website located at www………., as well as the service agreement formed through the user’s registration as a member with the Gym. The website of the gym, hereinafter referred to as “ULTRAFLEX,” was designed, developed, and is owned by the Private Company named “ULTRAFLEX ΙΔΙΩΤΙΚΗ ΚΕΦΑΛΑΙΟΥΧΙΚΗ ΕΤΑΙΡΕΙΑ” (ULTRAFLEX P.C.), hereinafter referred to as “Company” or “Gym”.

The account created is strictly personal and approved for one individual only, according to the submitted data. The accuracy of this data is the sole responsibility of the user, and they are required to keep their information correct and updated. Registered members must keep their username and password confidential. In case of unauthorized use, please inform the ULTRAFLEX administrators immediately. Acceptance of the terms implies acceptance of ULTRAFLEX’s policy regarding the use of the website and the fitness services provided.

1. Subject of the Agreement

The Gym provides fitness services, including the use of its facilities, equipment, and space by the Member, as well as support from specialized personnel. The Member wishes to register and use these services under the terms described herein, in return for the agreed fee, as listed in the Gym’s pricing catalog. The term ‘Gym’ refers to the legally licensed and operating gym located at Peristeri, Attica, 16 Ethnarchou Makariou St. ‘Member’ refers to any individual who enters into a service agreement with the gym through registration and payment of the subscription fee.

2. Binding Nature of the Terms

Acceptance of these terms is deemed to occur when the visitor/user accesses the ULTRAFLEX website. This acceptance constitutes an explicit, unconditional, and irrevocable agreement to comply with these terms. If the user disagrees with any term, they must cease browsing, delete their membership account, and refrain from purchasing a subscription.

3. Member Registration

By accepting the terms, submitting personal details, and paying the fee, the user registers as a member. Required information includes: 1. Full name, 2. Date of birth, 3. Complete address, 4. Contact numbers, 5. Email, 6. Tax ID, 7. ID or passport, 8. Medical certificate from a cardiologist or general practitioner. Pregnant women must also submit a gynecologist’s certificate. Minors can register only through their legal guardian. The member must notify the gym of any personal data changes. Medical certificates must be renewed every 12 months. A photograph and fingerprint are required for gym access. These are linked to the member’s profile and subscription. Failure to submit these documents may result in denied access without refund until submission.

4. Provided Services

ULTRAFLEX grants the Member access to its facilities and equipment, supervision by trainers, and use of additional amenities (e.g., locker rooms, posing room). Additional services like massage, physiotherapy, or nutrition may be available for an extra fee.

5. Subscription

Members may choose from monthly, quarterly, semi-annual, or annual subscriptions, detailed in the gym’s pricing catalog. Trial workouts cost 10€. Payment can be made in cash or by card. By paying, the member accepts the terms and fees as fair and appropriate, waiving any dispute rights.

6. Rights and Obligations of the Gym

The Gym must provide agreed services as described. It may modify operating hours or services based on needs or staff availability. It may restrict use for maintenance or repairs with prior notice. It may also change individual programs or trainers without notice.

7. Member Obligations

The Member must pay the agreed registration and subscription fees according to the gym’s pricing list. They must follow gym regulations and staff instructions, use equipment safely, and provide accurate personal and health information. The Member consents to photography and video recording within the gym for promotional purposes.

8. Execution Terms of the Contract

The contract becomes effective upon acceptance by the user. Services are available only to registered members, not third parties, and only during the gym’s operational days and hours. The gym may alter its schedule without notice, especially during holidays or due to force majeure.

9. Liability and Safety

The Gym bears no responsibility for injuries or damages due to negligence or improper use of facilities. Members assume full responsibility for their health and use of services. They must consult staff or a doctor if unsure about the suitability of exercises.

10. No Responsibility for Loss or Damage of Personal Items

The Gym is not liable for loss, damage, or theft of personal items. Members are advised to store valuables securely and avoid bringing them unnecessarily.

11. Safety, Hygiene, and Behavior Rules

Members must behave respectfully and use equipment properly. Equipment must be returned to its place after use. Lockers are only for use during gym visits and may be emptied by staff after hours. Illegal substances and supplement distribution are strictly prohibited. Proper hygiene, towels, and sports attire are mandatory. Children under 13 are not allowed in training areas. The gym does not offer childcare.

12. Membership Pause – Non-transferability

Pausing a subscription is allowed only for annual plans, up to one month, with mutual agreement and valid documentation. Pause is not available for discounted memberships. Subscriptions are non-transferable.

13. Termination of the Service Agreement

The contract ends: a) when the membership period expires, b) by mutual agreement, or c) through withdrawal or termination rights.

14. Member’s Right of Withdrawal

Members may withdraw within fifteen (15) days of accepting/signing the contract, via written notice. They are only charged for services rendered up to the withdrawal date.

15. Contract Termination by the Gym

The Gym may terminate the contract unilaterally without liability for violations of terms, non-payment, force majeure, or other extraordinary events.

16. Payments for ULTRAFLEX Services

Payments can be made via bank transfer or secure platform. ULTRAFLEX accepts cash or card. Receipts are based on provided data, and the user bears responsibility for accuracy. Receipts are emailed upon payment.

17. Refund Procedure

Any undue payments are refunded via bank transfer to the member’s IBAN within thirty (30) calendar days.

18. Termination of Associated Contracts

If services are paid via credit from the gym or a bank, and the member withdraws, they may cancel the credit agreement. The gym must notify the bank to stop further charges. Refunds or payment cancellations must be processed within 30 days.

19. Intellectual and Industrial Property Rights

All website and gym content is the property of the Company and protected under Greek, EU, and international law. Use or reproduction without written consent is prohibited. Any systematic extraction of data may lead to account deactivation and legal action.

20. ULTRAFLEX Liability Limitation

ULTRAFLEX is not liable for damages from accessing or using the website. Content is provided ‘as is’ without warranty. No guarantees are made regarding uninterrupted service, accuracy, or virus-free access.

21. Website User Responsibility

Users must follow internet etiquette and legal standards. They are solely responsible for submitted content and must not post illegal or harmful material. By submitting content, users grant ULTRAFLEX a free, irrevocable license to use it. The gym may restrict access to content violating its terms.

22. Personal Data

The gym legally manages personal data according to its Privacy Policy, which is part of this agreement.

23. Other Terms

This contract supersedes all prior agreements. It can only be amended in writing. If any term is deemed invalid, the rest remain in force. Greek legislation applies where not otherwise specified.

24. Dispute Resolution and Jurisdiction

This contract is governed by Greek law. Disputes may be resolved through mediation or the Consumer Ombudsman. Jurisdiction belongs to the courts of Athens.
